THE RIPPLE: PARTICIPANT AGREEMENT, ASSUMPTION OF RISK, AND RELEASE OF LIABILITY

PLEASE READ CAREFULLY. THIS IS A LEGAL AGREEMENT. BY SIGNING IT, YOU GIVE UP YOUR RIGHT TO SUE RIPPLE SPACE LLC AND THE OTHER RELEASED PARTIES FOR INJURY OR DEATH CAUSED BY THEIR NEGLIGENCE, AND YOU AGREE TO MEDIATE ANY DISPUTE BEFORE FILING A LAWSUIT.

Every guest must sign their own agreement.

PART 1: SOCIAL CONTRACT

When I enter The Ripple, I agree to:

• Help keep this a safe, welcoming, and affirming space for everyone.

• Be friendly and accepting of myself and others.

• Remember that we are here in community with each other. Sometimes community is inconvenient, and sometimes it asks for patience.

There is no room for hate here. I will leave appearance-based judgments at the door, reflect on any stereotypes I might hold, and keep self-critical thoughts to myself. I will respect other guests' privacy and will not photograph or record anyone without their consent.

I understand The Ripple may refuse entry or ask me to leave, without a refund, if my behavior is unsafe, disruptive, or violates this Agreement.

PART 2: BATHHOUSE RULES

• Swim wear required. Non swimwear fibers damage equipment.

• Shower before entering the hot tub and cold plunge, and after the sauna.

• Use the restroom before getting into the water.

• Dry off before leaving the wet room. Floors are wet and can be slippery; walk, don't rush.

• No alcohol, cannabis, or other intoxicating substances before or during my visit. I will not enter if I am impaired.

• No glass in the wet room.

• Time limits: no more than 20 minutes at a time in the sauna or hot tub, and no more than 10 minutes at a time in the cold plunge. We suggest about 11 minutes in the heat and 3 minutes in the cold.

• I will follow these time limits and any instructions from Ripple staff and session hosts.

• I will hydrate, and I will get out and tell staff right away if I feel dizzy, faint, nauseated, numb, short of breath, or unwell in any way.

PART 3: HEALTH ACKNOWLEDGMENT

I understand that sauna, hot tub, and cold plunge use place real demands on the heart, blood pressure, and body temperature. These activities may not be safe without medical clearance for people who are pregnant or may be pregnant, or who have heart disease or a heart rhythm condition, high or low blood pressure, a history of stroke, a seizure disorder, diabetes, Raynaud's or circulation problems, a respiratory condition, recent surgery, or open wounds, or who take medications that affect heart rate, blood pressure, body temperature regulation, or alertness.

I confirm that I am physically and mentally able to participate, that I have consulted a physician if any of the above applies to me or if I am unsure, and that no medical professional has advised me against these activities.

I understand that Ripple staff, session hosts, and facilitators are not medical providers, and that nothing offered at The Ripple, including breathwork, sound, and other guided sessions, is medical or mental health treatment. I am responsible for monitoring my own body and for stopping any activity at any time.

PART 4: ASSUMPTION OF RISK

I am participating voluntarily. I understand that using The Ripple's facilities and programs involves inherent risks, including but not limited to:

• Heat-related illness, including overheating, heat exhaustion, heat stroke, dehydration, and burns from hot surfaces or sauna heaters

• Cold-related effects, including cold shock, involuntary gasping, rapid breathing, hypothermia, and numbness

• Dizziness, fainting, and sudden changes in heart rate or blood pressure, including cardiac events

• Slips, trips, and falls on wet or uneven surfaces

• Drowning or near-drowning

• Waterborne or surface-borne illness or infection

• Effects of breathwork, such as lightheadedness, tingling, or emotional release, and other physical or emotional responses to guided sessions

• Injury caused by the actions of other guests

• Loss, theft, or damage to personal property

I KNOWINGLY AND VOLUNTARILY ASSUME ALL OF THESE RISKS, BOTH KNOWN AND UNKNOWN, EVEN IF THEY ARISE FROM THE NEGLIGENCE OF THE RELEASED PARTIES.

PART 5: RELEASE OF LIABILITY AND COVENANT NOT TO SUE

In exchange for being allowed to use The Ripple's facilities and participate in its programs, I agree as follows:

Released Parties. "Released Parties" means Ripple Space LLC, doing business as The Ripple, and its members, managers, owners, employees, independent contractors, session hosts, facilitators, volunteers, agents, insurers, successors, and assigns, and the owner and landlord of any premises where The Ripple operates.

Release. TO THE FULLEST EXTENT PERMITTED BY LAW, I RELEASE, WAIVE, AND DISCHARGE THE RELEASED PARTIES FROM ANY AND ALL CLAIMS, DEMANDS, AND CAUSES OF ACTION FOR INJURY, ILLNESS, DEATH, OR PROPERTY LOSS ARISING OUT OF OR RELATED TO MY PRESENCE AT, OR PARTICIPATION IN, ANY RIPPLE ACTIVITY, INCLUDING CLAIMS ARISING FROM THE NEGLIGENCE OF THE RELEASED PARTIES.

Covenant Not to Sue. I agree not to sue any Released Party for any claim I have released.

What This Does Not Cover. This release does not apply to gross negligence, recklessness, or intentional misconduct.

Indemnification. I agree to reimburse the Released Parties for losses, including reasonable attorney's fees, arising from my violation of this Agreement or the Bathhouse Rules, or from any claim brought on my behalf that I have released.

Who This Binds. This Agreement binds me and my heirs, executors, administrators, personal representatives, and assigns.

PART 6: EMERGENCY CARE

I authorize Ripple staff to call emergency services and to arrange first aid or emergency medical care for me if they believe it is needed. I am responsible for any resulting costs.

PART 7: MEDIATION BEFORE LEGAL ACTION

Mediation First. If any dispute arises out of or relates to this Agreement, my visit, or The Ripple's facilities or programs, both The Ripple and I agree to try in good faith to resolve it through mediation before either of us files a lawsuit.

How It Works. Either party may start mediation by sending written notice describing the dispute. For The Ripple, notice goes to info@theripple.space and to Ripple Space LLC, 5432 Butler St., Pittsburgh, PA 15201. We will choose a neutral mediator together within 15 days of the notice. If we cannot agree, the mediator will be appointed. Mediation will take place in Allegheny County, Pennsylvania, or by video if both parties agree.

Cost. The parties will split the mediator's fees equally. Each party pays its own attorney's fees for mediation.

Timing. If the dispute is not resolved within 60 days after the notice, or within any longer period we agree to in writing, either party may proceed in court as described below. Any statute of limitations is paused (tolled) from the date of the notice until mediation ends, so no one loses a claim by taking part.

Confidentiality. Everything said or shared in mediation is confidential and may not be used as evidence in any later proceeding, as provided by Pennsylvania law.

Skipping Mediation. A party who files a lawsuit without first starting mediation, when mediation was required, may not recover attorney's fees or costs that would otherwise be available to them in that action.

Exceptions. Either party may seek emergency court relief, such as an order to prevent immediate harm, without mediating first.

No Effect on the Release. Agreeing to mediate does not waive, limit, or revive any claim released in Part 5. Mediation is not binding unless both parties sign a written settlement.

PART 8: GENERAL TERMS

Scope and Duration. This Agreement applies to every visit, session, event, private party, and pop-up operated by The Ripple, including its pop-up at 5432 Butler St. and any future location, beginning on the date I sign and continuing until I revoke it in writing or am asked to sign an updated version. This Agreement remains in effect for any claim arising from my participation, even after The Ripple closes or leaves a location.

Governing Law. This Agreement is governed by the laws of the Commonwealth of Pennsylvania. Any dispute not resolved through mediation under Part 7 will be brought in the courts of Allegheny County, Pennsylvania.

Severability. If any part of this Agreement is found unenforceable, the rest remains in full effect, and the unenforceable part will be enforced to the greatest extent the law allows.

Entire Agreement. This is the complete agreement on these subjects, and no oral statements change it.
